The following is the contractual document that regulates the FONESTORE affiliate program, whose purpose is the generation of traffic, promotion and sale of its products by third parties. You must tick the acceptance box at the end of this document

The affiliate program can be accessed through the "AFFILIATES" section of the website, and the interested party (natural or legal person) can register as an affiliate, in accordance with these conditions and once they have registered using the form provided for this purpose.

Acceptance of this document implies that the AFFILIATE:

– He has read and understands what is stated here.

– That is a natural person over 18 years of age with sufficient capacity to contract or a legally constituted legal entity, through the natural person who holds the capacity of representation.

– That assumes all the obligations set forth herein.

These conditions will have an indefinite period of validity and will apply to all membership registrations made through the website.

FONESTORE reserves the right to modify these conditions, without this affecting membership registrations prior to any of these modifications.

 

1.- IDENTITY OF THE PARTIES TO THE CONTRACT.

The parts of the contract are:

And on the other hand, THE AFFILIATE, as a natural person over 18 years of age or a legally constituted legal entity, legitimate owner of one or more websites, who wish to affiliate to FONESTORE, in accordance with the provisions of these membership conditions.

2.- DEFINITIONS.

For the purposes of this contract, the following terms are defined as follows:

  • “Supports”: These are the AFFILIATE websites that are affiliated with FONESTORE.
  • “Affiliate Network”: is made up of all affiliates of FONESTORE.
  • “URL, Qualified Link or Link” is a link or link from a website AFFILIATE, which uniquely identifies the Support for its correct measurement of subscriptions, towards the site of FONESTORE using one of the required URLs or any other URL provided by FONESTORE for use in the Affiliate Network, if the last link the customer uses to reach the site of FONESTORE It is used during a “Session” where the customer subscribes to one of the services offered.
  • The “Affiliate Program” is the set of services offered by FONESTORE to its Affiliates, and which allows them to benefit from participating in said Network.

  • The “Contract” is the agreement between FONESTORE and the AFFILIATE.

 

3.- CONDITIONS FOR JOINING THE AFFILIATE PROGRAM.

3.1 Application for enrollment in the program

Registration in the affiliate program of FONESTORE It is free of charge and does not imply or obligate the AFFILIATES to make extra investments.

In case of technical incompatibilities that require the AFFILIATE Making an investment will be your sole responsibility. The following general criteria are established for accepting the application:

  • You must be over 18 years of age to be a Member. You must be a legally established individual of legal age or a legally constituted legal entity with full capacity to enter into contracts.
  • You must live in Spain to be an Affiliate.
  • To own, to have the rights to the website where you intend to place the link to the website of FONESTORE or be expressly authorized by said website for that purpose.
  • You must be a human. Accounts registered by “bots” or other automated systems are not allowed.
  • You must provide us with your full legal name (not pseudonyms), a valid email address, and other essential information to complete your registration and login process.
  • The user must correspond to a single person – single access by multiple people is not allowed.
  • You are responsible for maintaining the security of your account and password. FoneStore is not responsible for any loss or damage that may result from non-compliance with this obligation. 
  • You are responsible for all content you post as well as your account activity.
  • A user or legal entity cannot maintain more than one account.
  • You may not use the Affiliate Program for any illegal or unauthorized purpose. You must not, in your use of the Service, violate any laws in your jurisdiction (including, but not limited to, copyright laws).
  • The commissions applied will be cancelled if the referred customer cancels or requests a return of the product within 14 days after purchase.

To register as an affiliate, you must create a free customer account to access the "Affiliate Area," without needing to make any purchase. FONESTORE, You must provide the information specified in the form, with a user name (which will be the interested party's email address) and a password, provided by the user at their discretion, after reading and accepting the terms of use, privacy policy and contracting conditions, by checking the box indicating that they have read and accepted such terms and conditions).

It is essential for payment by FONESTORE of the commissions earned on AFFILIATE, that the latter has a PayPal payment service account.

The registration will take effect from the moment the interested party, within the Affiliates Area, clicks on the "Affiliates" tab and presses on the "Activate Affiliate account" button, after reading and accepting the affiliation conditions.

At that time, you will be able to access your control panel and by clicking on “Banners” you will be able to select the URL that the AFFILIATE can use in the provision of the affiliate service or qualified link called “Custom link using Affiliate ID”.

3.2 Acceptance of the registration request

FONESTORE The right is reserved to deny registration in the program if the applicant does not meet the necessary requirements or if the applicant's website displays inappropriate content.

FONESTORE It will assess the suitability of both the interested party and their website with the sole purpose of ensuring that the brand image is not harmed by the type of content or conduct of the website or its owners.

Nothing in this Agreement shall give rise, or be construed as giving rise, to the formation of a partnership between the parties or an employment relationship between them. FONESTORE and the AFFILIATE.

3.3 Service Management

He AFFILIATE will display on its website only the URL that refers customers to the website of FONESTORE, which is facilitated by FONESTORE. Balance: Sum of sales commissions that are within the 14-day warranty period for customers who have purchased a device to request a refund.

Fee Commission: Percentage of sales generated from sales through your referral links.

2) In the option SALES will have the following information:

The affiliate will be able to view their commissions according to the dates of the commission amount pending settlement, and can click the "Apply" button to view the reports included in those dates.

Affiliate payments will be made once the minimum commission exceeds €25.via bank transfer or Paypal. The "Pay to PayPal" option is used to generate payment to the PayPal account designated by the AFFILIATE the Friday following the date on which said settlement has been requested.

 

3) In the option PAYMENT HISTORY will have the following information:

4) In the option BANNERS will have the following information:

 

We provide both a personalized link to the affiliate account and the ability to create specific links to different products on the website.

We also provide custom banner designs for FONESTORE with different measures to adapt them to their contentsand that the AFFILIATE You can use it on your website by copying the corresponding URL.

 

5) In the option EDIT PROFILE will have the following information:

In this area the AFFILIATE You will be able to edit or update your personal data, email address, bank account or PayPal account, etc.

 

6) In the option GO OUT:

He AFFILIATE Clicking this tab will automatically log you out of your account. FONESTORE.

 

7) In the option IMPRESSIONS will have the following information:

The AFFILIATE You will be able to check the number of impressions of your banners or links. FONESTORE on their website to better calculate your digital marketing strategy.

 

4.- COMMISSIONS, ACCRUAL AND PAYMENT METHOD.

4.1. Commission:

FONESTORE will compensate the AFFILIATE, in the event of a sale of the products of FONESTORE through the link obtained in the AFFILIATE area, with a commission equivalent to 5% on the price paid by each client, an amount to which VAT will be charged at the current rate.

For these purposes, the purchase price of the products is understood to be the consideration paid by the customer, excluding applicable taxes (such as VAT) and if any discount is applied, the 5% commission would be applied to said reduced price due to the possible discount that may be applicable.

4.2. Accrual of the commission:

The right to the indicated commission will accrue if each and every one of the following conditions is met:

  1. Provided that the customer has purchased a product from the website of FONESTORE having accessed the website of FONESTORE through the “Custom Link” or unique affiliate URL.

When a user accesses the website of FONESTORE From the qualified URL or link, a cookie will be installed on the user's computer, which persists for a period of 3 months (tracking cookie). Therefore, if the user makes a purchase within that period, without having deleted said cookie, the AFFILIATE will be entitled to the accrual of the commission.

If the user deletes this cookie, AFFILIATE You will not be entitled to any commission, as it is impossible to detect that the contract is made through the qualified link.

Furthermore, and since all the qualified links of each AFFILIATE They install that type of cookie if a user clicks on the qualified link of a AFFILIATE, and then clicks on the qualified link of another AFFILIATE In this case, the tracking cookie for the latest URL will replace the previous one (and so on), so if that user buys any product at FONESTORE, The right to the commission will accrue to the holder of the last qualified link that the user clicked on.

It is understood that the tracking cookie is merely a system to try to facilitate the work of the AFFILIATES, without any type of responsibility being able to be demanded of FONESTORE in cases of this nature:

  1. FONESTORE must verify the payment by the user referred by the AFFILIATE, and remaining as an active CLIENT for a period of 14 days.This period is the time available to every new customer to try the product, and if necessary, withdraw from the contract and request a refund of the amount paid for said product.
  2. Prior to issuing and sending the corresponding invoice by the MEMBER to FONESTORE, provided that the authorization to issue invoices has been revoked FONESTORE.

 

4.3. Invoices:

In compliance with the provisions of the Article 5 of Royal Decree 1619/2012, of November 30 (Regulations governing invoicing obligations, the obligation to issue an invoice for Article 164, One, 3 of Law 37/1992 of December 28, on Value Added Tax, can be fulfilled by the recipients of the operations or by third parties.

Thus, the AFFILIATE authorizes in this contract to FONESTORE, so that it can issue invoices for the services provided by the AFFILIATE.

If the AFFILIATE If you require that, due to your personal circumstances, IRPF withholding applies, you must update the percentage in your personal data, in the "Edit profile" menu, in the "Billing: IRPF Percentage" field.

Since it is subject to VAT, the invoice will deduct the percentage of tax from the total amount due, according to current tax legislation.

FONESTORE will send a copy of the invoice to AFFILIATE.Each invoice issued in this way must be examined by the AFFILIATE, If no communication is made regarding this matter within ten days, it will be considered accepted by the latter.

  

4.4. Method of payment of the commission

Once each and every one of the commission accrual requirements has been met, and provided that a cumulative commission amount of at least €25 has been reached, the AFFILIATE You can choose, as referred to in point b) of section 3.3 above, from the following forms of payment:

Compensation: The AFFILIATE who is also a CLIENT of FONESTORE, can offset the commissions generated due to affiliation with the payment obligations you may have due to the products purchased in FONESTORE. To do this, you must send us an email to info@fonestore to receive the discount coupon for the value of the commission to be paid.

Under no circumstances will it be possible to transfer credit balances between different customer accounts.

Payment via PayPal: He AFFILIATE If you do not wish to make such compensation, you may request that the payment be generated in the PayPal account designated by you. AFFILIATE the Friday following the date on which said settlement has been requested.

Payment by Bank Transfer: He AFFILIATE If you do not wish to make compensation or payment through PayPal, you can request that the payment be generated in the bank account designated by the AFFILIATE the Friday following the date on which said settlement has been requested.

FONESTORE will not be responsible for fraudulently generated commissions that are not generated by actual sales and that can be verified with the payment methods applied in the online store.

 

5.- VALIDITY AND RESOLUTION.

The terms and conditions of this contract will take effect from the date of the AFFILIATE'S REGISTRATION and the obtaining of the qualified URL, link or connection.

Either party may terminate this contract with 5 days' notice, and the AFFILIATE must, once the contract has ended, remove from its Support(s) any link or connection to FONESTORE, and FONESTORE For its part, it must regularize all outstanding payments, thus terminating any contractual obligation, with no further claims against each other under the contract.

 

 6.- LOSS OF MEMBERSHIP STATUS.

FONESTORE reserves the right to revoke the status of AFFILIATE, if any of the following reasons occur:

  1. a) Failure to comply with any of the conditions stipulated in this contract.
  2. b) Unauthorized manipulation of the website of FONESTORE.
  3. c) Use of banners not provided and/or authorized by
  4. d) Use of the identifying elements of FONESTORE in advertising mailings of AFFILIATE through the Internet such as newsletters, email, or other advertising media such as postal mail, advertisements, brochures, letters, among others.
  5. e) The use of the trademark FONESTORE by the AFFILIATE with the aim of creating the appearance of a commercial partnership beyond the mere agreement signed in this document.
  6. f) The use by the AFFILIATE of unauthorized mass advertising (spam) techniques. Responsibility for non-compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, lies exclusively with the AFFILIATE, not authorizing FONESTORE no commercial communication via electronic means.
  7. g) The conclusion of operations or transactions by illicit or fraudulent means.
  8. h) Conducting paid search engine marketing (SEM) campaigns, such as Google Adwords, to promote landing pages with affiliate links using the brand FONESTORE, and any other conduct by which the AFFILIATE creates in users the false belief that it has a commercial relationship different from that regulated in these conditions and that it is limited exclusively to a mere provision of affiliate services for FONESTORE.
  9. i) The use of the qualified URL or link for the contracting of services by the AFFILIATE, or by creating customer accounts with the same personal data to receive self-commissions or with the personal data of blood relatives or relatives by affinity up to and including the second degree.

 

 7.- MEMBER'S OBLIGATIONS.

The AFFILIATE agrees to comply with this contract and all the clauses described therein from the moment the registration in the affiliation program is confirmed.

It will be the responsibility of the AFFILIATE to update its website, its content and the information displayed on it. FONESTORE will not be responsible for the AFFILIATE's failure to comply with its legal obligations regarding its website.

The AFFILIATE agrees to keep its website operational for the duration of this contract, as well as its email address, which will be used for communication with FONESTORE.

The AFFILIATE agrees not to modify the links and codes made available to them by FONESTOREfor the development of the service.

The MEMBER is obligated to keep their personal data updated.

 

8.- CONTRACTUAL MODIFICATIONS.

FONESTORE The company undertakes to notify any substantial modifications to the contract with sufficient notice. Members who disagree with these modifications have the right to request only the termination and settlement of this contract, without any further claims.

 

 9.- INCIDENTS.

FONESTORE declines any responsibility for problems arising from lack of access or those inherent to connectivity to the Internet or telecommunications networks when these originate from causes beyond its control or causes that could not have been foreseen by the Parties or that, even if foreseeable, FONESTORE has made all reasonable efforts to avoid them, or that they were considered as fortuitous causes or force majeure.

FONESTORE will not be liable for service failures that result in data loss in the information processing system, or failures in the security system or viruses or other harmful software components in the service. FONESTORE.

FONESTORE will not be responsible for any errors in the installation of links on the AFFILIATE Website or for the function specified in the links.

Any type of incident detected by the AFFILIATE that affects the normal functioning of the system will be reported to FONESTORE so that it can proceed with the correction.

FONESTORE informs that for technical maintenance reasons, access to the application may occasionally be restricted, understanding the AFFILIATE that these maintenance tasks are necessary for the proper functioning of the service.

 

10.- INTELLECTUAL PROPERTY.

FONESTORE It is the exclusive owner of all intellectual and industrial property rights over the different advertising media, computer programs, brands, logos, texts, creations, content, and designs that are part of the affiliate program.

It is not possible to reproduce, distribute, transform, publicly communicate, transfer or use source code of any of the applications, websites, developments or advertising media for purposes other than those stipulated in this contract.

Therefore, FONESTORE reserves the right to take action against anyone who is infringing its intellectual or industrial property rights.

He AFFILIATE You will not use any material made available to you for purposes other than those stated herein, unless you obtain prior written authorization from FONESTORE.

He AFFILIATE undertakes not to use the advertising symbols in any way that discredits or negatively represents FONESTORE, their image or their brands.

 

11.- CONSEQUENCES OF THE RESOLUTION OR TERMINATION.

Upon termination of this contract for any reason, the AFFILIATE will be completely disassociated from FONESTORE, The use of logos and banners or any allusion to the brand, logos, anagrams, or any other element of industrial or intellectual property owned by is expressly prohibited. FONESTORE.

 

12.- OTHER CONSIDERATIONS.

FONESTORE It does not guarantee the continuity of the affiliate program, so it may be terminated at any time by settling any outstanding payments.

Each party is responsible for the content and links included on its website.

 

13.- DATA PROTECTION.

The data will be collected by FONESTORE or by the data processors designated by her, for the purpose of managing their incorporation and continued participation in the affiliate program of FONESTORE.

Your data may also be used to send you information about our products and services, including via electronic means. Registration data must be truthful. If it is false, the user will not be able to participate in the affiliate program, and we reserve the right to take action. 14.- RESPONSIBILITIES.

He AFFILIATE will assume responsibility for the damages caused to FONESTORE for breach of the clauses contained in this contract, and specifically:

15.- LEGISLATION AND JURISDICTION.

In matters not stipulated in this contract, as well as in the interpretation and resolution of any conflicts that may arise between the parties as a result thereof, Spanish law shall apply.

To resolve any type of dispute that may arise as a result of the interpretation and execution of this affiliation contract, both parties will submit to the jurisdiction and competence of the Courts and Tribunals of Madrid.
