These conditions will have an indefinite period of validity and will apply to all membership registrations made through the website.<\/p>\n
FONESTORE reserves the right to modify these conditions, without this affecting membership registrations prior to any of these modifications.<\/p>\n
<\/p>\n
1.- IDENTITY OF THE PARTIES TO THE CONTRACT. <\/strong><\/h3>\nThe parts of the contract are:<\/p>\n

Hereinafter FONESTORE.<\/strong><\/p>\nAnd on the other hand, THE AFFILIATE<\/strong>, as a natural person over 18 years of age or a legally constituted legal entity, legitimate owner of one or more websites, who wish to affiliate to FONESTORE<\/strong>, <\/strong>in accordance with the provisions of these membership conditions.<\/p>\n2.- DEFINITIONS.<\/strong><\/p>\nFor the purposes of this contract, the following terms are defined as follows:<\/p>\n
\n- \u201cSupports\u201d: These are the AFFILIATE websites that are affiliated with FONESTORE<\/strong>.<\/li>\n
- \u201cAffiliate Network\u201d: is made up of all affiliates of FONESTORE<\/strong>.<\/li>\n

- The \u201cContract\u201d is the agreement between FONESTORE\u00a0<\/strong>and the AFFILIATE<\/strong>.<\/li>\n<\/ul>\n
\u00a0<\/strong><\/p>\n3.- CONDITIONS FOR JOINING THE AFFILIATE PROGRAM.<\/strong><\/h3>\n3.1 Application for enrollment in the program <\/strong><\/p>\nRegistration in the affiliate program of FONESTORE\u00a0<\/strong>It is free of charge and does not imply or obligate the AFFILIATES <\/strong>to make extra investments.<\/p>\nIn case of technical incompatibilities that require the AFFILIATE <\/strong>Making an investment will be your sole responsibility. You must be a legally established individual of legal age or a legally constituted legal entity with full capacity to enter into contracts.<\/li>\n
- You must live in Spain to be an Affiliate.<\/li>\n
- To own, to have the rights to the website where you intend to place the link to the website of FONESTORE\u00a0<\/strong>or be expressly authorized by said website for that purpose.<\/li>\n
- You must be a human. Accounts registered by \u201cbots\u201d or other automated systems are not allowed.<\/li>\n
- You must provide us with your full legal name (not pseudonyms), a valid email address, and other essential information to complete your registration and login process.<\/li>\n
- The user must correspond to a single person \u2013 single access by multiple people is not allowed.<\/li>\n
- You are responsible for maintaining the security of your account and password. FoneStore is not responsible for any loss or damage that may result from non-compliance with this obligation.\u00a0<\/strong><\/li>\n
- You are responsible for all content you post as well as your account activity.<\/li>\n
- A user or legal entity cannot maintain more than one account.<\/li>\n
- You may not use the Affiliate Program for any illegal or unauthorized purpose. You must not, in your use of the Service, violate any laws in your jurisdiction (including, but not limited to, copyright laws).<\/li>\n
- The commissions applied will be cancelled if the referred customer cancels or requests a return of the product within 14 days after purchase.<\/strong><\/li>\n<\/ul>\n
To register as an affiliate, you must create a free customer account to access the "Affiliate Area," without needing to make any purchase. FONESTORE<\/strong>, <\/strong>You must provide the information specified in the form, with a user name <\/strong>(which will be the interested party's email address) and a password, <\/strong>provided by the user at their discretion, after reading and accepting the terms of use, privacy policy and contracting conditions, by checking the box indicating that they have read and accepted such terms and conditions).<\/p>\nIt is essential for payment by FONESTORE\u00a0<\/strong>of the commissions earned on AFFILIATE<\/strong>, that the latter has a PayPal payment service account.<\/p>\nThe registration will take effect from the moment the interested party, within the Affiliates Area, clicks on the "Affiliates" tab and presses on the "Activate Affiliate account" button, after reading and accepting the affiliation conditions.<\/p>\n

FONESTORE\u00a0<\/strong>on their website to better calculate your digital marketing strategy.<\/p>\n <\/p>\n 4.- COMMISSIONS, ACCRUAL AND PAYMENT METHOD. <\/strong><\/h3>\n4.1. Commission: <\/strong><\/p>\nFONESTORE\u00a0<\/strong>will compensate the AFFILIATE, in the event of a sale of the products of FONESTORE\u00a0<\/strong>through the link obtained in the AFFILIATE area, with a commission equivalent to 5% on the price paid by each client, an amount to which VAT will be charged at the current rate.<\/p>\nFor these purposes, the purchase price of the products is understood to be the consideration paid by the customer, excluding applicable taxes (such as VAT) and if any discount is applied, the 5% commission would be applied to said reduced price due to the possible discount that may be applicable.<\/p>\n 4.2. Accrual of the commission: <\/strong><\/p>\nThe right to the indicated commission will accrue if each and every one of the following conditions is met:<\/p>\n \n- Provided that the customer has purchased a product from the website of FONESTORE\u00a0<\/strong>having accessed the website of\u00a0FONESTORE\u00a0<\/strong>through the \u201cCustom Link\u201d or unique affiliate URL.<\/li>\n<\/ol>\n
When a user accesses the website of FONESTORE\u00a0<\/strong>From the qualified URL or link, a cookie will be installed on the user's computer, which persists for a period of 3 months (tracking cookie). - Prior to issuing and sending the corresponding invoice by the MEMBER to FONESTORE<\/strong>, provided that the authorization to issue invoices has been revoked FONESTORE<\/strong>.<\/li>\n<\/ol>\n
\u00a0<\/strong><\/p>\n4.3. Invoices<\/strong>:<\/p>\nIn compliance with the provisions of the Article 5 of Royal Decree 1619\/2012, of November 30 <\/strong>(Regulations governing invoicing obligations, the obligation to issue an invoice for Article 164, One, 3 of Law 37\/1992 of December 28, on Value Added Tax<\/strong>, can be fulfilled by the recipients of the operations or by third parties.<\/p>\nThus, the\u00a0AFFILIATE <\/strong>authorizes in this contract to FONESTORE<\/strong>, so that it can issue invoices for the services provided by the AFFILIATE<\/strong>.<\/p>\nIf the AFFILIATE\u00a0<\/strong>If you require that, due to your personal circumstances, IRPF withholding applies, you must update the percentage in your personal data, in the "Edit profile" menu, in the "Billing: IRPF Percentage" field.<\/p>\nSince it is subject to VAT, the invoice will deduct the percentage of tax from the total amount due, according to current tax legislation.<\/p>\n FONESTORE\u00a0<\/strong>will send a copy of the invoice to AFFILIATE<\/strong>.Each invoice issued in this way must be examined by the AFFILIATE<\/strong>, If no communication is made regarding this matter within ten days, it will be considered accepted by the latter.<\/p>\n\u00a0<\/strong>\u00a0<\/strong><\/p>\n4.4. Method of payment of the commission <\/strong><\/p>\nOnce each and every one of the commission accrual requirements has been met, and provided that a cumulative commission amount of at least \u20ac25 has been reached, the AFFILIATE <\/strong>You can choose, as referred to in point b) of section 3.3 above, from the following forms of payment:<\/p>\nCompensation:\u00a0<\/strong>The AFFILIATE who is also a CLIENT of FONESTORE<\/strong>, can offset the commissions generated<\/strong> due to affiliation with the payment obligations you may have due to the products purchased in FONESTORE. AFFILIATE <\/strong>the Friday following the date on which said settlement has been requested.<\/p>\nPayment by Bank Transfer: <\/strong>He AFFILIATE <\/strong>If you do not wish to make compensation or payment through PayPal, you can request that the payment be generated in the bank account designated by the AFFILIATE <\/strong>the Friday following the date on which said settlement has been requested.<\/p>\nFONESTORE will not be responsible for fraudulently generated commissions that are not generated by actual sales and that can be verified with the payment methods applied in the online store.<\/strong><\/p>\n\u00a0<\/strong><\/p>\n5.- VALIDITY AND RESOLUTION.<\/strong><\/h3>\nThe terms and conditions of this contract will take effect from the date of the AFFILIATE'S REGISTRATION and the obtaining of the qualified URL, link or connection.<\/p>\n Either party may terminate this contract with 5 days' notice, and the AFFILIATE must, once the contract has ended, remove from its Support(s) any link or connection to FONESTORE<\/strong>, and FONESTORE\u00a0<\/strong>For its part, it must regularize all outstanding payments, thus terminating any contractual obligation, with no further claims against each other under the contract.<\/p>\n\u00a0<\/strong><\/p>\n\u00a06.-\u00a0<\/strong>LOSS OF MEMBERSHIP STATUS.<\/strong><\/h3>\nFONESTORE\u00a0<\/strong>reserves the right to revoke the status of AFFILIATE, if any of the following reasons occur:<\/p>\n\n- a) Failure to comply with any of the conditions stipulated in this contract.<\/li>\n
- b) Unauthorized manipulation of the website of FONESTORE<\/strong>.<\/li>\n
- c) Use of banners not provided and\/or authorized by<\/li>\n
- d) Use of the identifying elements of FONESTORE\u00a0<\/strong>in advertising mailings of AFFILIATE <\/strong>through the Internet such as newsletters, email, or other advertising media such as postal mail, advertisements, brochures, letters, among others.<\/li>\n
- e) The use of the trademark FONESTORE\u00a0<\/strong>by the AFFILIATE <\/strong>with the aim of creating the appearance of a commercial partnership beyond the mere agreement signed in this document.<\/li>\n
- f) The use by the AFFILIATE of unauthorized mass advertising (spam) techniques. Responsibility for non-compliance with Law 34\/2002, of July 11, on Information Society Services and Electronic Commerce, lies exclusively with the AFFILIATE<\/strong>, not authorizing FONESTORE\u00a0<\/strong>no commercial communication via electronic means.<\/li>\n
- g) The conclusion of operations or transactions by illicit or fraudulent means.<\/li>\n
- h) Conducting paid search engine marketing (SEM) campaigns, such as Google Adwords, to promote landing pages with affiliate links using the brand FONESTORE<\/strong>, and any other conduct by which the AFFILIATE <\/strong>creates in users the false belief that it has a commercial relationship different from that regulated in these conditions and that it is limited exclusively to a mere provision of affiliate services for FONESTORE. <\/strong><\/li>\n
- i) The use of the qualified URL or link for the contracting of services by the AFFILIATE<\/strong>, or by creating customer accounts with the same personal data to receive self-commissions or with the personal data of blood relatives or relatives by affinity up to and including the second degree.<\/li>\n<\/ol>\n
\u00a0<\/strong><\/p>\n\u00a07.-\u00a0<\/strong>MEMBER'S OBLIGATIONS.<\/strong><\/h3>\nThe AFFILIATE agrees to comply with this contract and all the clauses described therein from the moment the registration in the affiliation program is confirmed.<\/p>\n It will be the responsibility of the AFFILIATE to update its website, its content and the information displayed on it. | | | | | | |
